Terms and Conditions
This section outlines the Legal Terms and Conditions for any purchases of products listed on our Salumeria Italia website and are applicable to:
- the purchase of Products on Salumeria Italia website;
- the use of any information, documents, graphics, movies, features, music and/or other services on the Website.
Salumeria Italia website is operated by Jeranto S.r.l., an Italian food wholesale distributor, whose registered office is at Via dei Mille, 7 – I-80035 Nola (NA) – Italy under Economic and Administrative Index No. (R.E.A.): NA-926445 in the Company Register, Italian Fiscal Code and VAT no. 08023781217
These general conditions and all disputes arising in connection with these general conditions, including the validity thereof, or with the use of the Website or with any purchases on the Website shall be governed by Italian law. The Court of Nola shall have exclusive jurisdiction.
1. Customer Registration
To order from Salumeria Italia, you must be a Trade customer registered with us.
Upon registration, you would need to provide us with certain details, including but not limited to Company details, address, email and delivery address. You must ensure that the details provided to us are accurate at all times and inform us promptly of any changes to your details. You are responsible for keeping your account details up to date.
When you register your account, you are asked to create a password. This must be kept confidential at all times and not disclosed or shared with anyone. You will responsible for all orders and activities on your account that are submitted under your password.
We reserve the right to refuse the registration of customers and terminate accounts.
Registered customers with an active account can use the online shopping facility on the Website and view the product prices.
You may select the Products you wish to purchase and add them to your shopping cart. Once you conclude your order you may select “Proceed to “Checkout. At the checkout screen you can still review your order including shipping costs and make any changes if necessary.
You need to accept the Terms and Conditions and click the “Place Order” button.
Your order confirmation number will appear on the screen and also sent to you via email along with a Proforma Invoice
You need to check the proforma invoice carefully and contact our Customer Services if you find any mistakes. Otherwise, please proceed with the bank transfer payment.
Following the completion of your order we advise you to log out of your account to prevent misuse by anyone else.
We reserve the right to refuse or cancel any order (already accepted by us) in (amongst others) the following situations, without being liable for any damage or costs:
- the product is not available / in stock (any payments will be refunded);
- your billing/shipping information is not correct or verifiable;
- your order is flagged up by our security systems as an unusual order or an order susceptible to fraud;
- your bank transfer payment is not received within 7 business days after acceptance of your order;
- there was an error in the price quote;
- you breach any of the Terms & Conditions.
3. Products and Pricing
Once the payment is received on the basis of the proforma invoice, we will proceed to fulfil your order. However, whilst we try to ensure that all items offered for sale are in stock, the Products on the website are subject to availability. If we are unable to deliver an item you have ordered, we will contact you and try to offer you a substitute product -a suitable alternative – in its place. If you do not wish the substitute product we will remove the original product from your order and you will not be charged for it. Substitute Products will be charged at their normal price.
We reserve the right not to accept any orders or to cancel confirmed orders for Products that are out of stock and not accept any liability or unavailability of Products. In such event we will inform you by e-mail and any payments will be refunded.
Prices are only visible to registered users with an active account
Products that are priced by weight (€ /per kilo) are often displayed by the average weight of this specific Product (for example some cheese and meat products). Your order and proforma invoice will be made on the basis of the average weight.
Once your order is processed, the Products sold by weight will be weighted and the cost of the purchased Products will be adjusted to reflect their actual cost and a commercial invoice will be sent to you
The price of a Product does not include delivery charges, which you must also pay. Our delivery charges are as quoted on the website and will be displayed before you submit your order to us.
Please note that even though the Website is composed with care, it is possible that the pricing information on our Website contains errors. If we discover an error in the price of the Products you have ordered we will inform you of this error and we will give you the option of continuing to purchase the Product at the correct price or cancelling your order. We reserve the right to cancel your order in the event of such error.
The offers on the Website are valid only the moment that they are displayed on the website, unless a specific term is communicated on the website. We are not bound by any offer in the event of spelling, pricing or other errors or mistakes in the Website information. We reserve the right to cancel any purchase concluded in the event of such error.
The Product prices displayed on the Website are exclusive of Value-Added Tax (VAT).
Prices are quoted in Euro. If your local currency is different from the currency the prices are quoted in, your bank will apply the exchange rate applicable per the date of purchase. Your bank may apply a different exchange rate, which is beyond our control.
Bank transfer is the only acceptable payment method. Please transfer the exact amount specified on the proforma invoice using the unique reference order number stated in your order confirmation.
Once you have made a payment in relation to a specific order you have entered a Contract to Buy and can only cancel your order as per the Cancellation clause.
Many of the Products on the website are sold by weight according to the €/kg price displayed on the Product description page. The weight indicated on each Product page is approximate to help you estimate the total amount of the order. This estimate amount will appear on the Proforma invoice and will need to be paid for the order to be dispatched.
The commercial invoice will always reflect the actual cost of all the Products delivered to you:
- Products sold by weight will be weighted and their exact cost will be shown;
- Products that are out of stock and could not be delivered will be refunded;
- Substitute Products that have been accepted by you will be charged at their normal price.
The commercial invoice will be sent to you electronically once your order has been shipped. In most cases, the proforma invoice amount and the commercial invoice amount will differ slightly:
- if the commercial invoice amount is greater than the proforma invoice amount paid, you are kindly requested to pay the difference within 5 business days from the delivery date;
- if the commercial invoice amount is less than the proforma invoice amount paid, you will receive a credit note and a full refund of the difference within 5 business days from the delivery date. You can also ask to use the credit against your next purchase.
We try to limit the difference between the proforma amount and final invoice amount to the extent this is commercially reasonable, given the weight variability of the Products offered for sale.
If there is any mistake in the commercial invoice, our liability is limited to the price of the incorrect Product.
5. Shipping and Delivery
All Products are shipped from Italy on pallets to business addresses only. All Products are shipped Carriage Paid To (CPT) the named place of destination (INCOTERMS® 2010), under the terms published by the International Chamber of Commerce (ICC).
A flat rate shipping is applied per order. Orders over € 3.000 ship for free.
Shipping fees will be communicated in the order confirmation email.
All orders are delivered by Standard delivery, usually within 7 business days. We deliver Products from Monday through Friday. Orders are shipped from Italy every Tuesday. Orders confirmed by Monday are shipped the same week. Orders confirmed after Monday are shipped the following week. Orders placed over public and/or national holidays will be processed on the following workday.
We aim to deliver on time to the extent this is commercially reasonable but we cannot always guarantee timely delivery. If we are unable to deliver to you for reasons beyond our control, for example adverse weather conditions, supplier shortages, strike actions, we cannot accept liability for any inconvenience and loss this may cause.
We make every effort to deliver your order in a single delivery. However, we reserve the right to split your order for instance (but not limited to) if part of your order is delayed or unavailable. In the event that we split your order, we will notify you in advance by e-mail. You will not be charged for any additional delivery costs.
Inspection upon Delivery
Please note that all orders are shipped on pallets and it is your responsibility to unload them from the delivery truck.
Upon delivery, inspect the packaging for damage. If it appears damaged, please do not accept the shipment and notify us by telephone or email as soon as possible.
Once you accept the delivery, inspect the Products and contact us as soon as possible if there are issues with any of the Products.
We will refund the purchase price of damaged or incorrect Products and all delivery costs as soon as the warehouse has handled your return.
6. Cancellations and Returns
Salumeria Italia reserves the right to cancel any accepted order or your registration as per clause 2.7 under Orders
You may cancel your registration with us at any time by informing us in writing. However, you would need to settle any outstanding liabilities towards us before we delete your account.
If you wish to cancel an order you have submitted, please contact our Customer Services as soon as possible to check the status of your order. If your order has not yet been shipped you can request a cancellation free of charge. However, if an order has been shipped, the order can no longer be cancelled or amended.
To protect our customers and for health & safety reasons, the right of return is only for damaged Products at the time of delivery. We are unable to accept returns of perishable Products, including alcoholic and non-alcoholic beverages, since we are unable to guarantee that the Products have been preserved adequately.
Incorrect Product (Products that you did not order) or damaged Products would need to be returned to us for inspections.
In all cases you need to contact our Customer Services prior to initiating a Product return.
For all the aforementioned cases that a refund is due to you, it will be issued based on the original form of payment, i.e bank transfer. Customer Services will confirm your Bank details so that we can refund the money directly to your account. You will receive your refund after the Product has been returned and the cancellation has been processed.
7. General Website Information & Liability
Even though the Website has been composed with care, the information, pricing, texts, documents, graphics and/or other services on it may contain errors or be otherwise incorrect or incomplete. We shall not be not liable for any damages resulting from the use of (or inability to use) the Website, including damages caused any incorrectness, or incompleteness of the Information, by viruses or unless such damage is the result of any wilful misconduct or from negligence on our the part.
All brand names, Product names and titles used on the website are trademarks or trade names of Jeranto/Salumeria Italia or third party trade mark or trade name holders. You are not allowed to use of reproduce any such trade marks or trade names as this may constitute an infringement of the holders’ rights. All Website design, texts, documents, movies, music and/or other services and the selection and arrangement thereof, and all software compilations, underlying source code, software (including applets) and all other material on this website are the copyright of Jeranto or its suppliers. You are only allowed to electronically copy and to print in hard copy portions of the Website to the extent this is necessary for the purpose of placing an order with us, or for using the Website as a shopping resource. You are not allowed to make any other use of the information and materials on this website, including reproduction for purposes other than those noted above, modification, distribution, or republication. Should you wish to use materials or information from this Website, you need to obtain our prior written consent.
Where the Website provides links to external Internet sites, we shall not be liable for the use or the content of Internet sites that link to this site or which are linked from it.
If we have reason to believe that the security in your account on the Salumeria Italia website has been compromised we may require you to change your password or cancel your account. You also need to contact us immediately if you suspect there is any misuse of your trading account.
Retention of title
We retain title in the Products until we have received full payment for all such Products.
We also reserve the right to refuse service, terminate accounts, remove or edit content or cancel orders in our sole and absolute discretion
We shall only be liable for damages suffered by you in the event such damages result from attributable breach by Jeranto of its contractual obligations towards you, or in the event Jeranto’s liability follows from applicable statutory law.
In the event you have suffered damages in relation to our activities on the Website, our liability will be limited to:
damage to the Jeranto Products or to other materials;
- reasonable and demonstrable costs incurred by you to find out the cause and the amount of the damages under a);
- reasonable and demonstrable costs incurred by you to prevent or reduce the damage under a).
The maximum reimbursement of the above damages will (if applicable) be the purchase price of the Products concerned.
We shall not be liable for damage incurred by a third party resulting from the use of any of our Products. We shall not be liable for damage incurred by you as a result of your improper use of any of our Products.
We are not liable for damages as a result of incorrect information on the Website.
